Booking Terms and Conditions
The terms and conditions of HOLIDAY/ SHORT TERM LETTING are as agreed by all parties, and by the primary Guest submitting this agreement each party acknowledges and accepts these terms and conditions when a booking is made. An infringement of any of the prescribed terms and conditions may result in Homes for Holidays exercising the right to terminate the tenancy without notice, refuse to give out a key for a property, enforce a monetary penalty or amend a rental amount at any time.
The persons booking the property must be the person residing at the property and understand they are responsible for actions for the group and accountable for each and every individual. The property is let for HOLIDAY/ SHORT TERM LETTING and only for the period agreed by all parties and stated on the booking for the maximum number of guests booked. Exceeding the maximum number of guests booked will receive a $40 per person per night charge and will render the Guest liable to cancellation of the booking immediately and forfeiture of any rental monies and bond monies.
ARRIVALS | Your booking commences at 3pm on the confirmed date of arrival. You will receive your check in details and key access prior to your stay commencing. |
DEPARTURES | The property must be vacated by 10am sharp on the date of departure unless you have arranged and paid for a late check out. Keys to be returned to the key safe immediately following vacating and or the digital door locked. Late departures will be charged a fee of $100.00 per hour. This amount will be taken from the security bond/ credit card and reported to the booking platform. |
BOOKINGS | All bookings and tariffs are subject to change without notice, bookings are not confirmed until the pre booking checklist form is completed and all bookings and deposits received are subject to the landlords’ approval and receipt of deposit monies. Payment of 50% of the full tariff is required to secure the booking. The balance of the full rental tariff is due 30 days before your booking commences. Keys will not be issued unless all monies are paid and completed with a copy of your credit card, driver’s license and pre-stay form. |
CANCELLATIONS | Bookings cancelled at least 60 days prior to check in will receive a full refund less the 3% booking surcharge and $220 admin fee. Bookings cancelled within 60 days – the full deposit or tariff held will be forfeited. |
BOND PREAUTHORISATION | This bond acts as a security deposit for the length of occupancy. By booking the Guest agrees that funds may be deducted from their allocated credit card, after vacancy, without notice. Claims may include, but are not limited to any excess rubbish left at the property, any damage, breakages, loss or excessively soiled linen, loss of linen, damage to linen, excess cleaning required, un-necessary maintenance calls, if the property is found to be smoked in, un-clean BBQ, failure to check out on time, loss of keys or remotes, or any other unsatisfactory items that are evident upon inspection. |

MORNINGTON SHIRE COUNCIL SHORT STAY LAWS | All Homes for Holidays guests must abide by the Mornington Peninsula Shire’s Short Stay Rental Accommodation Local Law 2018. Under these local laws, unacceptable behaviours include:

MAINTENANCE | The guest must immediately (within 24 hours) notify Property Management of any complaint or problem with the property, should there be one, and allow Homes for Holidays a reasonable amount of time to remedy the problem or find the guest suitable alternate accommodation if the problem cannot be resolved within a reasonable amount of time. The Accommodation Manager must use discretion in deciding the severity and outcome of the complaint or problem. Failure to notify Homes for Holidays will void any claim following the booking period and vacating the property does not constitute an adequate cause for the guest to be refunded. |
SMOKING | Smoking is not permitted inside any rental properties. The security bond may be forfeited should there be evidence of smoking inside; minimum $250 charge for fumigation, minimum $250 charge for collection of cigarette butts. |
PETS | Pets are not permitted unless you have booked your pet to stay with you and the permission has been granted, Where permission has been granted you will be required to pay the pet fee charge You will be required to clean up after your pet including hair removal and faeces removal. The security bond may be forfeited and used to fumigate and clean the property should there be evidence of pets when they have not been booked in to stay with you. $200 Fumigation $150 Faeces collection $150 Animal hair removal |
PARTIES | No parties or large entertainment groups are permitted at the rental property. If a report is received from a neighbour, the police may be called and this may result in your booking being cancelled immediately without refund of tariff or bond. If a complaint is lodged to local council a $600 charge will be withheld from your bond. Additional charges or immediate termination may apply in the event of unnecessary or excessive noise nuisance or disturbance caused to neighbouring properties during your occupancy. |
DAMAGE | The Guest is responsible for any damage, breakages or loss incurred during the period of occupancy. Items that need to be replaced will be at the cost of the same OR similar item which will depend on availability and wait times. All items required to be replaced must be available for the next guest and not affect the following booking. Costs associated with damage, breakages, excess cleaning or loss will be charged to the Guest and deducted from the guest credit card provided together with $150 administration fee depending on time involved to resolve matter for Homes for Holidays |
INSPECTIONS | The Agent/Landlord or any person approved by the landlord may access the property at any time upon demand. |
KEYS | The Guests are responsible for all keys/remote controls. Lost/damaged keys: At cost plus maintenance cost |
LINEN | All linen and towels are provided for your stay. Please BYO beach towels, At the end of the occupancy period linen must be left on beds and all used towels are to be placed in the laundry bag provided and left in the laundry/bathroom of the property. The cost for excess laundering or damage or missing linen will be subject to current professional laundering costs and charged accordingly to the security bond. |
CLEANING | It must be reported to the managing agent immediately should the property be found unclean. It is the Guest’s responsibility to leave the property in the same condition in which it was received. This includes removing any food from the pantry, drinks from the fridge and for the removal of all rubbish. Although we endeavour to have the property insect and cobweb free please be aware that the Mornington Peninsula & Gippsland regions can experience an influx of insects especially in the warmer months. Excess cleaning is charged to the Guest at $55.00 per hour. |
RUBBISH | In areas where garbage collectors empty bins once per week, recycle bins are emptied every second week. Bins must be placed at the kerb upon departure or early on collection dates at each property. Otherwise follow the instructions at the property Rubbish bags left on the nature strip will not be picked up by the garbage collectors; it is the Guests responsibility to remove all excess waste and ensure that bins are left out to be emptied. Please ensure all bins are left out the night before you leave the premises, or if bin night falls during your stay please ensure bins are put out. Bins left overflowing with garbage, or any excess rubbish left at the property will incur a fee of $50.00 per bag and will be deducted from security deposit. If bins are found full, it must immediately be reported to the agent at the commencement of your stay. |
PERSONAL POSSESSIONS | No responsibility will be taken by the landlord or agent for the Guest’s personal property, any personal items left behind will be returned and held at our office and for a period of 14 days, you will be contacted to collect but after this date the items will be disposed of. We do not offer a postage service for items left behind, you will need to collect or arrange a courier. Homes for Holidays recommends that all guests take out travel insurance. |

INDEMNITY | The Guests/occupants indemnifies the agent against any liability which may result through loss, injury, being personal or proprietary suffered by any person where any injury, damage or loss has been contributed to or caused by any act or occasion of the Guest or their agent. The agent reserves the right to be sole arbitrators in the event of a dispute. No responsibility will be taken by Homes for Holidays PTY LTD for any misconception of a property where a booking has been made by email, internet or telephone. We cannot be held liable for any actions of our landlords which may result in the tariff being increased prior to occupancy, we have no control over the property being altered by the landlord in any way prior to occupancy, we cannot control or be responsible for the property becoming unavailable for letting prior to occupancy, we cannot control or be responsible for the property being sold prior to occupancy. In any of these instances we will endeavour to find an alternative property but cannot make any guarantees, nor can we assure you of being able to find a replacement property at short notice. Homes for Holidays PTY LTD may reserve the right to retain the deposit should the guest cancel the booking and a replacement booking is not made. Homes for Holiday PTY LTD reserves the right to cancel the booking at any time. |
